MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />JULY 17,2000 <br />{U2602 JOHN GRAHAM, Continued) <br />Lindquist moved, Kluth seconded, to recommend approval of Application ^2602, <br />John Graham, 1065 Tamarack Drive, for a two lot subdivision, with the understanding that <br />the storage barn will be removed or a residence constructed on Lot 1 within 18 months of <br />approval of the preliminary plat by the City Council. <br />Smith commented the Applicant may need to look at relocation of the shed if they do not plan to <br />develop this lot within the next year or two. <br />Graham reiterated the City could require a covenant on this property requiring that the shed either <br />be removed or a principal structure constructed within a certain period of time once ownership <br />of the lot changes. Graham stated that covenant would be recorded with the title and any new <br />property owner would be aware of the restrictions on that shed. <br />Nygard commented the 18 months gives the Applicant time to look at his options regarding this <br />lot. <br />Lindquist inquired whether the Applicant would like the Planning Commission to vote on the <br />motion that has been made. <br />Graham stated he would like the Planning Commission to go alicad and vote on the motion. <br />VOTE ON THE ABOVE MOTION: Ayes 4, Nays I, Nygard Opposed. <br />(^5) #2600 BRIAN KERBER, 740 ORCHARD PARK ROADS - VARIANCES, <br />7:51 p.m. - 8:18 p.m. <br />Brian Kerbcr, Applicant, was present. <br />The Certificate of Mailing and Affidavit of Publication were noted. <br />Weinberger stated the Applicant has submitted a land use application requesting variances to <br />permit construction of 60’ by 40 ’ (2,400 square foot) pole bam on his 4.8 acre property. City <br />Code currently permits a nmimum structure of 2,000 square feet. This pole bam would be <br />considered an oversized accessory stmcturc. A second variance is needed to permit relocation of <br />the Uvo-stall garage 72.9’ from the side street lot line where 100’ is required. City C, v'; docs not <br />permit detached garages or other accessory buildings to be located neared the front ,>• lot <br />line than the principal building on a non-lakcshorc lot. <br />Weinberger stated this property is located in the five acre zoning district of the City along <br />County Road 6 and Orchard Park Road. Neither of the buildings would be fully visible to the <br />adjacent properties and would not be visible to the property to the south based on the mature <br />trees between the lots. Access to the pole bam would be gained off of County Road 6. Weinberger <br />noted the cast half of the property consists of low land and w etland area. <br />Weinberger stated one issue to consider is the new Highway 12 corridor will affect seme if the <br />property in this area. <br />PAGE 12 <br />KaXarm»M.m rtfrtilgV
