4.This is the first known application in Sugar Woods for an accessory structure encroachment
of a protected yard area. There have been a small number of requests under the supplemental
rules for driveway encroachment at the time of home construction. Driveways going straight
in from the street are the only allowed hardcover encroachment of protected Sugar Woods
yard areas; a few have been granted variances to angle in to protect specified trees.
5. Does Planning Commission have any additional issues or concerns with this proposal?
Options for Action:
1.Recommend approval of variance to allow the sport court to be constructed on the property
as shown on the survey.
2. Require the sport court to be moved further from the rear property line; any setback less than
SO' still requires a variance.
3. Advise applicant what other possible revisions will make the application acceptable.
4.Other.
Staff Recommendation:
Keeping in mind the potential for establishing a precedent. Planning Commission should review the
applicant's submittals and stated hardships, and determine whether justification exists to grant the
requested variance.
U2601 John and Karen Blank
2100 Sugarwood Drive
Variance
7/17/2000
Page 3
