4.This is the first known application in Sugar Woods for an accessory structure encroachment <br />of a protected yard area. There have been a small number of requests under the supplemental <br />rules for driveway encroachment at the time of home construction. Driveways going straight <br />in from the street are the only allowed hardcover encroachment of protected Sugar Woods <br />yard areas; a few have been granted variances to angle in to protect specified trees. <br />5. Does Planning Commission have any additional issues or concerns with this proposal? <br />Options for Action: <br />1.Recommend approval of variance to allow the sport court to be constructed on the property <br />as shown on the survey. <br />2. Require the sport court to be moved further from the rear property line; any setback less than <br />SO' still requires a variance. <br />3. Advise applicant what other possible revisions will make the application acceptable. <br />4.Other. <br />Staff Recommendation: <br />Keeping in mind the potential for establishing a precedent.
