The property is located in the RR-IB zoning district. Orono zoning code refers to section R-1 A, <br />(Conditional Use Permits) Section 10.20, Subd. 3 (Q) which states approval of a toilet, bathtub or <br />shower in an accessory building, shall be conditioned on provision of municipal sanitary sewer or <br />a conforming sewage treatment system designed to handle the anticipated flows from the building <br />plumbing. Approval shall be granted only when the following criteria are met: <br />1. The Council finds that the proposed use for the accessory structure with plumbing will not be <br />detrimental to the residential character of the neighborhood. <br />2. The Council finds that the plumbing fixtures proposed are in keeping with the intended use of the <br />accessory building. <br />3. The property is 2.0 acre in area or larger. <br />The property meets the minimum requirement of 2.0 acres. It is approximately 2.153 acres. <br />4. The accessory building is conforming in location, size and height. <br />The proposed pool house is 10'x 20' or 200 s.f An accessory structure of this size is to be <br />located 10'from the side property line. The "pool house " is proposed to be located 19'‘20'jrom <br />the property line as shown on the survey (Exhibit B). It is not located closer to the street than the <br />principal structure and does not exceed the height of the principal building, therefore is considered <br />as conforming. <br />5. The property owner agrees to the filing of a covenant in the title of the property providing that: <br />a. The accessory building will not be used for a home occupation unless specifically <br />approved by City of if allowed by City code. <br />b. The accessory building will not be used as a dwelling unless a guest house CUP is <br />obtained. <br />c. The accessory building will not be rented, leased or otherwise provided for use as dwelling <br />under any circumstances. <br />Such covenant shall be binding on current and future property owners and shall be filed in the chain <br />of title of the property. <br />Stplis; <br />The existing septic system was built for a 5 bedroom residence, installed in April, 1999 and is up to <br />code.
