All lots located on the north side of Chippewa Lane are between 1 and 2 acres and only 1 of the 7 <br />lots has frontage of 300'. <br />Lot Width Variance: <br />Because the larger lot would result in less than 300' of frontage along Chippewa Lane a variance is <br />required for lot width. The property is a legal conforming lot for lot area and lot width prior to <br />subdivision. The only lot on the south side of the Chippewa Lane that is non-conforming is the 4265 <br />lot. <br />Primary Issues for Discussion: <br />1. <br />2. <br />3. <br />Orono has approved lot line rearrangements in the past. In most cases when lots did not meet <br />the minimum lot size requirements and the subdivision was approved the properties had <br />existed as two residential sites in the past. The proposed lot line rearrangement does not <br />increase the density between the two lots. Under the existing zoning no future subdivision <br />is possible. <br />Technically, the lot would require a variance for lot width since the lot would become <br />substandard. <br />The lot line rearrangement results in the 4355 lot being reduced in lot width to less than 300'. <br />This is significant because as the lot exists it is a conforming lot (lot area and lot width). <br />The Subdivision Code does not address creating lots with walkways to access public land. <br />Proposed is to provide a 10' wide walking access to the Luce Line Trail for the 4265 lot. <br />Planning Commission Options for Action: <br />1.Approval of variances based on the Statement of Hardship. <br />2.Denial of variances, stating reasons. <br />3.Table, requesting further information and provide direction to the applicant. <br />4.Other Action. <br />Thomis ind Kathleen McCaffrey <br />Fred and Joyce Shemanek <br />4265 and 4355 Chippewa Lane <br />Subdivision of a Lot Line Rearrangement <br />\fay 15, 2000 <br />pagt-3
