/ 5 <br />TO: <br />FROM: <br />DATE: <br />RE: <br />Chair Hawn and Orono Planning Commissioners <br />Ron Moorse, City Administrator <br />Paul Weinberger, Zoning Administrator/Planner <br />February 23, 2000 <br />#2513 Connie Piepho <br />540 North Arm Drive <br />Variance <br />Zoning: LR-1 A, One Family Lakeshore Residential, 2 Acres <br />Application: To permit construction of an inground swimming pool within the average lakeshore <br />setback. <br />Exhibits: <br />A Revised Proposal <br />B Planning Commission Minutes (August 9,1999) <br />C Staff Report (August 9,1999) <br />Application Summary: The Planning Commission reviewed this application at the August 16,1999 <br />Public Hearing and recommended approval on a vote of 5 to 0 to approve an average lakeshore <br />setback variance on the property subject to the propert>' owner identifying a secondary septic site on <br />the property. The previous proposal had placed the swimming pool in an area designated as the <br />secopvi.’ry septic site on the property. Since the Public Hearing no testing has been completed on <br />the property to attempt to identify new sites. Rather the property owner has submitted a new site <br />plan that relocates the pool to the north property line. Staff s position is the site plan has been <br />altered therefore it is appropriate the application should return to the Planning Commission for <br />review prior to moving the request forward to the City Council. <br />This application is for an average lakeshore setback to permit construction of an inground pool at <br />540 North Arm Drive. For swimming pools, the setback is measured from the water basin to the <br />propert>' line. The size of the setback is set by the size of the basin, which in this case is less than <br />750 sq. ft. requiring a 10 foot setback to the property line. The pool itself (the water area) is <br />currently proposed at 15' from the side property line where 10' is required. The area surrounding <br />the pool is allowed to encroach into the sideyard setback provided it is not at a height greater than <br />that of the main floor of the home.
