3.Section 10.03, Subd. 14 (C): Lot Coverage: In all zoning districts, for all lots of 0-1.99 acre in <br />total area, the total combined footprint areas of all principal and accessory structures shall not exceed <br />15% of the lot area. Variance Request: To permit 3,576.45 s.f (23.2%) of lot coverage, where 3,589 <br />s.f. (23.3%) exists and 2,305 s.f. (15%) is allowed. <br />Planning Commission Recommendation and Application Summary: The Planning <br />Commission voted on November 15, 1999 and January 19,2000 to table the application so the <br />applicant could redesign a lakeside deck to conform more with Orono’s zoning code. <br />The applicants have applied for variances to replace an existing second story deck on the lakeside <br />of the house. The deck, floor boards and joists that were built into the house originally are rotting. <br />The deck extends 4' from the house and is the full width of the house (54.2'). In addition to replacing <br />the existing deck the applicant is proposing to add a small section onto the deck. The section would <br />be approximately 8' x 12' to allow a sitting area. The house was built in 1959 at its present location <br />and has not been added onto. The driveway is shared with neighbors through an easement and the <br />lot is undersized for its zoning district. <br />Brief Summary of proposed changes: <br />The applicants were advised by the Planning Commission to stay within the square footage of the <br />existing deck with no increase in structural or hardcover coverage on the lot. The new site plan <br />(Exhibit B) is attached. <br />The Planning Commission tabled the application at the request of the applicants. The applicants <br />have revised the plans addressing the following concerns: <br />Structural Coverage: The existing structural coverage for the lot is 3,589 s.f. (23.3%), <br />including the existing deck which is 216.8 s.f. The redesigned deck is 204.45 s.f., a <br />reduction of 12.55 square feet. The reduction of the deck reduces the structural coverage on <br />the lot to 3,576.45 s.f. (23.2%). A variance is still needed for lot coverage. <br />Hardcover Coverage: The hardcover percentage in the 75-250' setback area is currently <br />6,960 s.f (77.11%). The removal of landscape fabric on the lot (829 s.f) and redesign of the <br />deck reduces the hardcover from 6,960 s.f (77.11%) to 6,118.45 s.f. (67.7%). A variance <br />is still required for hardcover within the 75-250* setback area. <br />Average Lakeshore Setback: The redesigned deck does not encroach further into the <br />average lakeshore setback. It will be located approximately 24' from the property line and <br />will not hinder the adjacent neighbor’s views of the lake. Because of the unusual lot <br />configuration to the north, the existing deck encroaches 55' into the average lakeshore <br />setback. (See Exhibit D).
