The dev eloper has completed <br />most of the requirements of the preliminary plat resolution as of the date of this memo. Council adopted a <br />resolution on December 1 1th, in response to a Citizen Petition for the preparation of an EAW, determining <br />that the development proposal by Brenshell Homes has no potential significant environmental effects and <br />denying the EAW request. Prior to releasing the plat for filing the developer must complete the following: <br />□ <br />□ <br />□ <br />□ <br />□ <br />Final street designs, sanitary sewer, grading and stormwater management facilities shall be provided <br />for approval by the City Engineer. <br />Final approval of the stormwater management plan by the MCWD. (The Board deferred to vote on <br />the final plan until the City had made a determination whether an EAW would be required.) <br />Final covenants, easement documents and maintenance agreements shall be approved by the City <br />Attorney, including language within the maintenance agreements that would permit the City of <br />Orono the ability to require maintenance and assess fees to the property owners within Wildhurst <br />Woods. The documents shall give the City the ability to access the property for ongoing monitoring <br />of the stormw ater management system. <br />Payment of Park Fees and Sewer Connection Fees. <br />Letter of credit in the amount of 150% of improvement fees shall ue received by the City subject to <br />the execution of a Developer’s Agreement between the developer and the City. <br />Title Opinion shall be approved by the City Attorney. <br />The developers intend to have completed most of the items listed above prior to the meeting on ><onday <br />night. Council can approve the final plat subject to the items listed above and all requirements of <br />preliminary plat approval being complete prior to recording the plat. <br />Council Action Requested <br />Motion to adopt the resolution approving the final plat of Wildhurst Woods subject to the developer <br />completing the conditions prior to filing the subdivision and execution of the Developer’s .Agreement. The <br />developer shall be responsible for placing monuments/posts defining conservation areas on the property.
