F <br />■ <br />It <br />CITYof ORONO <br />m;mi!k <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ________________ <br />a 'minor arterial* roadway requiring a minimum right-of-way width of 80', which <br />already exists. This area of County Road 6 is shown as a bikeway corridor on <br />the Hennepin County Bicycle Transportation Plan. The Council is aware of <br />Hennepin County policies regarding the sharing of right-of-way acquisition costs <br />in relation to County requests for right-of-way in conjunction with plats. <br />However, the Council has concluded that the mere platting of the Club property <br />absent the creation of any new residential lots which would generate users of <br />such a trail, does not appear to meet the nexus and rough proportionality tests <br />for exaction of a dedication from the developer for trail purposes. The City has <br />chosen to not require a Park Dedication Fee of this developer for this very <br />reason. Further, the request for added right-of-way is not accompanied by a <br />defined County plan for an upgrade of the road. Therefore, the Council <br />concludes that the Hennepin County request for additional right-of-way for <br />County Road 6 must be denied. <br />9.The property contains a significant number of natural wetlands and drainageways, <br />as well as a number of wetland areas, drainageways, stormwater ponds and <br />similar facilities that have been created or modified as a result of construction <br />of the Spring pill Golf Course as approved via CUP Resolution No. 3902. All <br />such features are being shown on the plat, and Drainage Easements or Flowage <br />and Conservation Easements as deemed appropriate will be granted by the <br />applicants over all said features. <br />10.An existing Flow'age and Conservation Easement within tax parcel 26-118-23 44 <br />0003 is no longer necessary because a new and expanded easement will be <br />dedicated over it. Therefore, the existing easement within said tax parcel should <br />be vacated per the applicants' request. <br />NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of <br />the findings noted above, the City Council of the City of Orono hereby approves the <br />preliminary plat application of Spring Hill Golf Club at 725 Sixth Avenue North per plat <br />drawings by Theodore D. Kemna, a licensed surveyor of Schoell and Madson, Inc., dated April <br />29, 1999 subject to the following conditions: <br />Page 3 of 6 <br />i
