While many <br />alternatives have b-=ien discussed concerning this development, <br />including legal acticn under the Minnesota Environmental Rights <br />Act, the neighbors have appreciated the efforts that the City <br />has made to try to ensure that this proposed development, being <br />built partially on steep slopes, does not cause excessive <br />environmental damage or adversely affect their property. <br />Many concerns still remain, however. After examining the <br />minutes of September 25, I noticed that there was no reference <br />to the comments made by Gary Welsh concerning his belief that <br />this process was flawed. In addition, the resolution granting <br />preliminary approval requires, eimong other things, the grant of <br />a conservation easement nn pcrti?r~ cf Lo’: 2 and 3 brlcw the <br />1,014 foot contour. The neighbors would appreciate it if the <br />terras of this easement were spelled out now rather than remaining <br />indefinite. They also want this area clearly delineated in some <br />manner, perhaps with metal posts as was done by the City on the <br />Saga Hill property. <br />Needless to say, the construction of a stormwater pond in <br />an area where the slope may exceed 18% also raises concerns for <br />the adjoining property owners.
