I M/Ji ^ 50 I A <br />^^^ublic.Us^ V Private User License No.License Fee:I <br />Licensed Geographic Information System Data Base(s):• • <br />(1)2000 Digital Orthopheto Images at 20,000ft, CD-ROMS <br />(2) <br />(3) <br />(4) <br />(5) <br />(6) <br />THIS GIS DATA BASE LICENSE AGREEMENT (“License Agreement”) is made and entered into <br />by and between the Metropolitan Council (“Council ”), a public corporation and po^^tical subdivision of <br />the State of Minnesota, and the individual, organization or entity identified above as ‘’Lser.” <br />WHEREAS, the Council represents that the geographic information system data :ise(s) (“GIS Data”) <br />identified above are public government data that have commercial value and v^ere developed with <br />significant expenditures of public funds by the Council; and <br />WHEREAS, Minnesota Statutes section 13.03, subdivision 3 authorizes the Council to charge a <br />reasonable fee for the GIS Data to recover actual development costs as well as -*.e costs of maNing, <br />certifying and compiling copies of the GIS Data; and <br />WHEREAS, the purpose of this License Agreement is to make public government cata accessible to the <br />public and to protect the public’s interest in recovering the significant expenditures of public funds used <br />to develop the commercially valuable GIS Data. <br />NOW THEREFORE, in consideration of the mutual terms and conditions suted in this License <br />Agreement, the Council and User agree as follows: <br />I.DEFLNITIONS <br />1.01 “C?/5 Data" means the geographic information system data base(s) identiiui above which were <br />developed by the Council and which are subject to and governed by this License Arriement. <br />1.02 ^^Metropolitan Area" means the nineteen counties surrounding Minneapclis and Saint Paul <br />includine .Anoka, Carv'cr, Chisago, Dakota, Goodhue, Hennepin, Isanti, LeSueur, M:Leod, Ramsey, ice, <br />Scott, Sherburne, Sibley, Washington and Wright counties in Minnesota and Pierce. Polk and St Croix <br />counties in Wisconsin. <br />1.Q3 "Private User" means any User which is not a “Public User.' <br />Page I of 5 Pages
