City Council Meeting <br />November 13,2000 <br />8.U2626 William and Lynn Peterson, 420 Orchard Park Road—Variance and <br />Right-of-Way Vacation—Resolution No. 4562 —Continued <br />between the public and private land. <br />Flint moved, and Peterson seconded, to adopt Resolution No. 4562 granting a <br />variance to Municipal Zoning Code Section 10.27, Subdivision 5(B) to permit the <br />property to be a buildable lot where 4.3 acres exist and 5 acres are required for <br />residential use and denying vacation of platted right-of-way, with the change to <br />condition 4 stating that the right of the public to share his driveway shall only exist <br />in the portion of the driveway on land currently owned by the City. <br />Vote: Ayes 5, Nays 0. <br />*9. #2627 WillmarThorkelson, 440 Big Island—Aftcr-the-Fact Variance <br />Resolution No. 4563 <br />Sansevere moved, and Peterson seconded, to adopt Resolution No. 4563 granting a <br />variance to Municipal Zoning Code Section 10.31, Subdivision 8(C) to allow an <br />accessory structure to be located 23 feet from the platted street right-of-way where <br />30 feet is required. <br />Vote: Ayes 5, Nays 0. <br />10.#2628 Roger Anderson, 2200 Shadjwood Road—Variances—Resolution No <br />4564 <br />Flint requested this item be removed from the Consent Agenda because he had a question <br />about the letter from the City Engineer suggestion plantings along the lake front, which <br />was not mentioned in the resolution. Gaffron stated that the letter was asking for a buffer <br />on the land consisting of 15 - 20 feet of unmowed vegetation along the shoreline. Mr. <br />Anderson stated that they will take proper erosion control measures during construction, <br />including a silt fence and a swale just outside the 0 - 75 foot zone. Kelley stated he was <br />not in favor of the vegetation, and that if the City wanted to encourage that form of <br />erosion control, it should be done city-wide as an ordinance. Flint stated he was <br />concerned that the recommendation was made, but not incorporated into the resolution. <br />Gaffron stated that was because there was no ordinance to support the recommendation. <br />Flint moved, and Kelley se<'onded, to adopt Resolution No. 4564 granting a variance <br />to Municipal Zoning Code Section 10.25, Subdivision 6(B) to allow new residential <br />construction on a 0.38 acre lot where 0.5 acre is required and having a lot width of <br />52 feet where 100 feet is required. <br />Vote: Aves 5, Navs 0.• ^ m <br />*11. #2632 Temple Israel, 645 Tonkawa Road—Conditional Use Permit <br />Resolution No. 4565 <br />Sansevere moved, and Peterson seconded, to adopt Resolution No. 4565 granting a <br />mi
