W:P-U- <br />.1^ <br />% <br />^ • <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.55. SUBDIVISION 8 <br />FILE NO. 2643 <br />WHEREAS, Patrick M. Burton and Kirsten M. Burton, (hereinafter "the applicants") <br />are the owners of the property located at 2601 Rainey Road within the City of Orono (hereinafter <br />"the City") and legally described as follows: <br />Lot 3, Block 1, TREES TO BE and Outlot B TREES TO BE, CITY OF ORONO, <br />Hennepin County, Minnesota (hereinafter "the propert> "); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.55, Subdivision 8 to permit the construction of a private driveway through <br />a wetland where no fill is normally allowed. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on November 20,2000, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />1. <br />2. <br />3. <br />FINDINGS <br />This application was reviewed as Zoning File ?=2643. <br />The propert>’ is located in the RR-IB Zoning District, where 2 acres or 87,120 s.f. is <br />the minimum required lot area. The property consists of approxirr- i -.ly 13.86 acres. <br />The Orono Planning Commission reviewed this application on cr 20,2000 <br />and recommended approval by a vote of 6 to 0. <br />4.The Planning Commission made the following findings of fact: <br />Page 1 of 5
