^' <br />i <br />i- <br />Prior Use - We understand that 1968 is the date that governs prior use. We have reviewed <br />1971 Heard aerial photographs that show there is one boat shed or boathouse on this non ­ <br />conforming lot. That further supports that there should be no more than one dock on this <br />property ’. <br />Hard Cover Driveway - There is a hard cover gravel drivevv’ay within the 0-75 foot setback. <br />We understand that city codes do not allow this and that no permits were ever requested or <br />granted for the driveway. In 1999, the driveway was expanded from accommodating 2 to be <br />able to accommodate 4 cars. We would ask that as part of any conditional use permit that <br />the gravel driveway be removed. <br />Blocking of Fire Hydrant - The non-permitted driveway that Ginther and Ault have put in is <br />immediately adjacent to the only fire hydrant in the immediate area. Frequently, four cars <br />are parked on the gravel driveway making easy' and quick access to the fire hydrant virtually <br />impossible. Within the last 24 months, there have been 2 home fires in our immediate <br />neighborhood where the fire trucks used this fire hydrant. Thankfully, it was at a time when <br />cars were not parked immediately next to the fire hydrant, which allowed the fire <br />department to get to the fire hydrant. We wouic* ask that, as part of any conditional use <br />permit, parking not block the fire hydrant. <br />■ Burglar Alarms - As referenced earlier, Ginther’s burglar alarm created major disruption to <br />the neighborhood in the past. We would ask that burglar alarms not be allowed at this <br />property. <br />Parking for Only One Car per Dock - Consistent with the other conditional use permits for <br />the other non-conforming docks, we w’ould ask that only one car be allowed to park for each <br />dock. Since we believe there should be only one dock at this property, we w'ould request that <br />only one car be allowed to park at any given time on this property and that that parking be in <br />a spot that didn’t limit access to the fire hydrant and didn’t violate hard cover restrictions. <br />Remov’al of Electricity - Per the previous discussion on the non-conforming dock lots, we’d <br />request that electricity be removed from this property. <br />Noise Guidelines - Since this property' is at the end of a very narrow lagoon area, we’d <br />request strict noise guidelines be incorporated into any conditional use permit granted for <br />this property ’. We’d also ask that boats not come or go from these docks after 10:00 p.m. on <br />weelmights and 11:00 p.m. on weekends so as not to wake up the neighbors and disturb the <br />neighborhood. <br />We would respectfully ask that until all of the above issues can be satisfactorily discussed and <br />resolved that no action be taken on applicant’s request for a conditional use permit. Both <br />Richard Gay and Jim Zimmerman plan to appear at the Planning Commission meeting. Dick <br />Ogle will be out of tow'n and thus unable to testify in person. <br />We hope the above information provides some helpful background on what we see as a very <br />serious and expanding problem. We respectfully ask for the city ’s help in resolving the many <br />issues surrounding the non-conforming dock lots. <br />.Si <br />I
