r- <br />k'.. <br />■t <br />I:" <br />A <br />A RESOLUTION GRANTING AN AFTER THE FACT VARIANCE <br />TO ORONO MUNICIPAL ZONING CODE SECTION 10.22, <br />SUBDIVISION 2 AND SECTION 10.56, <br />SUBDIVISION 16 (L) (1) <br />FILE NO. 2571 <br />WHEREAS, James O. Ginther and Clara Joanne Ginther and Douglas R. Ault <br />and Kristen Ault (hereinafter the "applicants") are owners of a property located at 2739 <br />Shady wood Road in the City of Orono (hereinafter the "City") and legally described as <br />follows: <br />The northeasterly 110 feet of Tract U, Registered Land Survey No. 415, Files of <br />Registrar of Titles, Hennepin County, Minnesota (hereinafter the "property"); and <br />WHEREAS, the applicants have applied to the City for an after the fact <br />variance to Municipal Zoning Code Sections 10.22, Subdivision 2 and Section 10.56, <br />Subdivision 16 (L) (1) to permit an expansion of a parking area constituting an increase in <br />hardcover on the property with the 75' lakeshore setback. <br />WHEREAS, the Orono Planning Commission reviewed this application at a <br />public hearing held on October 16, 2000; and <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File ^2571. <br />The property is located in the LR-IB, Single Family Lakeshore Residential <br />District requiring a minimum lot size of 43,560 s.f.
