(.84 acre) <br />Council Review <br />The Council voted to return the review of the variance back to the Planning Commission to discuss <br />options on the property for deck replacement without increasing the size of the deck. The Planning <br />Commission had voted 7 to 0 to recommend denial of the request based on the size of the deck <br />within the 75' setback would increase. The applicant has requested further review of the application <br />with the Commission to review an alternative plan. The revised plan is attached as Site Plan A2 to <br />this memo. <br />Application Summary: Applicant had requested approval of an after-the-fact variance to <br />permit replacement of a deck within the 75' setback to a protected tributary. The applicant has stated <br />the preexisting deck was not safe and needed replacement. In July, 2000 it was obser\ ed the deck <br />was being replaced w ithout a permit.
