A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.25. SUBDIVISION 6(B), <br />SECTION 10.22, SUBDIVISION 1(B), AND <br />SECTION 10.56, SUBDIVISION 16(C)(6), <br />FILE NO. 2609 <br />WHEREAS, Alan I. Opheim and Maxine V. Opheim, (hereinafter "the applicants") <br />are the owners of the property located at 1985 Fagemess Point Road within the City of Orono <br />(hereinafter "the City") and legally described as follows; <br />Lot 3, Fagemess, including the accretions thereto lying betv/een the northwesterly <br />extensions to the shore line of Lake Minnetonka of the northeasterly and <br />southwesterly lines of said Lot 3, and including the accretions to said Lot 3 lying <br />southeasterly of a line which is parallel with and 40.00 feet southeasterly from the <br />southeasterly line of said Lot 3 and between the southeasterly extensions to the shore <br />line of Lake Minnetonka of the northeasterly and southwesterly lines of said Lot 3, <br />Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.25, Subdivision 6 (B) to allow a three season porch to be constructed on <br />an existing concrete slab located 6.9 ’ from the side yard lot line where 10' is required and Section <br />10.22, Subdivision 1(B) and Section 10.56, Subdivision 16(C)(6) to allow the three season porch to <br />encroach 73' into the average lakeshore setback. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Plaiming Codes, the Orono Planning <br />Commission held a public hearing on September 18,2000, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1.
