r <br />w <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.27. SUBDIVISION 5(B), <br />FILE NO. 2608 <br />WHEREAS, Philip A. Skoog and Karen S. Skoog, (hereinafter "the applicarts") are <br />the owners of the property located at 280 Tonka Avenue within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />Lots 9 and 10, Block 2, Lot 18, Block 5, “Bayside Addition to Lake Minnetonka ”, <br />and that part of Hill Street vacated which lies between the Southerly extensions of <br />the East and West lines of said Lot 9, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.27, Subdivision 5(B) to allow a rear yard setback of 39 ’ where 50' is <br />required for a dining room addition to the rear of the residence and Municipal Zoning Code Section <br />10.27, Subdivision 5(B) to allow a front yard setback of 43 ’ where 50' is required to allow a two stall <br />detached garage to the south side of the residence. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September 18,2000, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />1. <br />2. <br />NOW, THEREFORE, BE !T RESOLVED by the City Council of Orono, <br />FINDINGS <br />This application was reviewed as Zoning File #2608. <br />The property is located in the LR-1 A, Single Family Lakeshore Residential Zoning <br />District, where 2 acres or 87,120 s.f. is the minimum lot area. The property consists <br />of approximately .55 acres or 23,750 s.f. <br />3. The Orono Planning Commission reviewed this application on September 18,2000 <br />Page 1 of 5
