ORONO CITY COUNCIL MEETING <br />MONDAY, SEPTEMBER 11,2000 <br />ii- <br />5.#2596 Brenshell Homes, 1181 Wildhurst Trail—Class 111 Subdivision <br />Preliminary Plat Approval—Continued <br />The surveyor was notified of the meeting, but was not the appropriate person to invite. <br />Mr. Benke stated that he is listed as the contact person on the application. He stated that <br />the new information was provided in response to a staff request. <br />Mayor Jabbour stated that normally when new information is presented to the Council, <br />they refer the application back to the Planning Commission for review. The application <br />in front of Council should be denied. Mr. Benke stated that the new information simply <br />demonstrated that the applicant was willing and able to comply with all of staff s <br />requests. <br />Mr. Tom Stokes, President of Brenshell Homes, stated that they were trying to respond to <br />staff requests, and it would be appropriate for everyone to have an opportunity to review <br />the new information. <br />Mayor Jabbour stated that the Council should have the benefit of the opinions of the <br />Planning Commission, staff, and neighbors before moving on the application, and that <br />requires a certain process. Mr. Stokes suggested the application be tabled so they could <br />incorporate the changes suggested by staff and go back to the Planning Commission. <br />Barrett reminded Mr. Stokes that he had a right to a decision at the Council meeting, and <br />that he would be waiving that right in order to extend the application deadline. Mr. <br />Stokes asked if he could begin the process anew if the application was denied by Council. <br />Barrett stated he would have to wait 6 months to resubmit the application. Mr. Stokes <br />stated he preferred to table the application. He reviewed a letter to that effect and signed <br />it. <br />Mayor Jabbour withdrew hb motion, and Flint withdrew his second, to deny the <br />application. <br />Peterson moved, and Kelley seconded, to table the application and refer it back to <br />the Planning Commission. <br />Vote: Ayes 5, Nays 0. <br />*6. #2606 Rick’s Super Value, 3333 Shoreline Drive—Commercial Site Plan <br />Review and Variances—Resolution No. 4518 <br />Peterson moved, and Sansevere seconded, to adopt Resolution No. 4518 granting <br />variances to Orono Municipal Zoning Code Section 10.42, Subdivision 7(G); Section <br />10.56, Subdivision 16(L) and Section 10.61, Subdivision 10(0) and approves the <br />issuance of a building permit for Rick’s Super Value for property located at 3333 <br />Shoreline Drive per Municipal code Section 10.42, Subdivision 2 approving the <br />commercial site plan, building elevations and landscape plan, and approving the
