Weinberger indicated the project would be <br />inspected periodically by the City Engineer to insure compliance with the final plans. Weinberger <br />stated the developer is also required to enter into a development agreement, which mandates that <br />certain conditions are met on the project. <br />Berg commented that the City does not release any funds on the letter of credit until an inspection <br />has been completed by the City Engineer to insure proper compliance with the approved plans. <br />Hawn commented the Plaiming Commission needs to rely on the advice of their e.\perts in <br />determining whether the drainage for this area is appropriate and proper in controlling the water <br />runoff. <br />Stoddard requested City Staff review further any possible impact to the bluff in this area. <br />Weinberger conunented City Staff has reviewed that issue, with the determination being made that <br />the bluff should not be negatively impacted. <br />Behnke indicated the bluflf in this area does not meet the necessary criteria to be considered an <br />actual bluff. <br />Stoddard stated he would like City Staff to review this issue again. <br />Hawn commented the Planning Commission and City Council are required to act in accordance <br />with the City’s ordinances. Hawn indicated the proposed plan does meet the City’s criteria, with <br />the developer having the right to develop the land regardless of the desires of the adjoining <br />property owners. Hawn stated it is the responsibility of the City Engineer and City Staff to insure <br />that these issues are being addressed properly. <br />PAGE 23
