It was the majority opinion ofthe Planning Commission <br />the proposed subdivision meets the requirements of the Zoning Code. The Planning Commission did have <br />concerns with the amount of information regarding environmental impacts of developing the property. <br />The areas on proposed Lots 2 and 5 near the ravines is primarily the concern regarding potential erosion <br />concerns and the ability for the stormwater management ponds. In response to concerns addressed by the <br />City, they had revised the plan to better protect these areas. This included relocating the pond on Lot 2 about <br />40' to require less grading in the area near the drainage ravine. The trees at the edge of the ravine would be <br />protected. The property line between Lots 2 and 3 has be i shifted to the north and the road length shortened <br />to bring the building areas of the lots to the top of the hill and to increase the buffer area to the ravine. <br />The Planning Commission had a failed motion to table the application (3 to 4) to request additional review <br />of the impacts of the development and to allow the MC WD an opportunity to review the wetland delineation <br />for the property. The developer had hired Kjolhaug Environmental Services Company to complete a review <br />of the wetlands and determined the NWl map does not indicate wetlands on the site. They also completed <br />a site inspection and found no hydrophytic plant communities, wetland hydrology, or hydric soil indicators. <br />Kjolhaug noted in their letter, dated September 15,2000, "There are no areas on the Wildhurst Site meeting <br />wetland criteria. The neighborhood group had provided a report that was completed in 1997 that found a <br />small area of wetland on proposed Lot I. The MCWD has visited the site and will make a determination on <br />the reports completed on the property. <br />Attached is a copy of the Staff Report that was presented to the Planning Commission on September 18,2000 <br />for review. <br />Council Action Requested <br />Motion to direct Staff to draft a resolution based on the plan dated September 1 2,2000 attached to this memo <br />as Exhibit A.
