3. <br />5. <br />6. <br />7. <br />The Orono Planning Commission reviewed this application on August 21,2000 and <br />recommended approval by a vote of 5 to 0. <br />4. The Planning Commission made the following findings of fact: <br />A.The excavation of fill and creation of an open water wildlife pond will result <br />in an improved or upgraded wetland providing greater surface runoff <br />detention and habitat for wildlife. <br />B.Approximately 1600 yards of fill will be removed from the existing wetland <br />creating approximately 16,000 s.f, of surface area. <br />C. Fill removed from the existing wetland will remain on the property. <br />The City Council finds that the conditions existing on this property are peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variance would not adversely affect traffic conditions, light, air, nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property right of the applicants; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council finds that granting a conditional u.se permit to allow creation of a <br />wildlife habitat pond would not to be detrimental to the health, safety or general <br />welfare of the public, would not adversely affect light, air nor pose a fire hazard or <br />other danger to neighboring properties, nor will it depreciate surrounding property <br />values and that the proposed level of use of the property will be in keeping with the <br />intent and objectives of the Zoning Code and Comprehensive Plan r he City. <br />The City' Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments <br />by the applicants and the effect of the proposed variances on the health, safety and <br />welfare of the community. <br />Page 2 of 5
