8-21-00 <br />To:Chair Hawn & Orono Commission Planning Commission Members <br />Ron Moorse, City Administrator <br />Paul Weinberger, Zoning Administrator/Planner <br />From:Bradley & Lori Bakke <br />(Neighbor sharing the East Lot Line at 3345 Crystal Bay Road) <br />Subject: #2593 Ace Properties <br />3349 Crystal Bay Road <br />Variances—Public Hearing <br />Back in 9-28-94 The City Orono approved the attached variance to add a new <br />deck & railing on top of the garage at 3349 Crystal Bay Road. ( Resolution # <br />3472, file #1961.) <br />The Orono Planning Commission recommended approval based upon: <br />3. <br />C. Deck & rails does not create a new view encroachment for <br />neighboring Properties. <br />If you allow variance applicants to build up above the area above the deck or <br />even to do the same with new construction, you would not be sticking to one <br />Of the conditions the Planning Commission required in order to recommend <br />approval for Resolution # 3472. <br />If you can’t get what you want the first time around why would it be OK to get <br />2^ variance upon the 1** variance in such a piece-meal fashion? <br />If you are will to set such a precedent why not just oper. the flood gates and <br />Change the 75' setback ordinance to a 70 ’ or 65 ’ setback. <br />The City Council found that by granting tne 1994 Variance it would not <br />adversely affect the light nor air of the neighboring property. <br />if you allow them to build 2 % stories within 75’ of the lake K will adversely affect <br />the sunlight, daylight & NW breeze onto my property. Where I now have a view <br />of the lake I will be looking at a 2 story sidewall. <br />Besides the 75’ setback, there are two other major concerns that could adversely <br />impact me.
