r- <br />r <br />L. <br />Agreement No. W-00-04 between the Board of Government Innovation and Cooperation and the <br />Cities of Long Lake and Orono <br />DRAFT <br />AGREEMENT <br />THIS AGREEMENT, which shall be interpreted pursuant to the laws of the State of Minnesota <br />between the State of Minnesota, acting through its Board of Government Innovation and <br />Cooperation (hereinafter BOARD), <br />And; <br />Address: <br />City of Long Lake and the City of Orono <br />2750 Kelley P irkway <br />Orono, Minnesota 55356 <br />(hereinafter LOCAL GOVERNMENT UNITS), witnesseth that: <br />WHEREAS, the BOARD, pursuant to Minnesota Statutes 465.797, is authorized to grant <br />temporary, limited exemptions from enforcement of state procedural laws governing delivery of <br />services by a local government unit; <br />AND WHEREAS, the LOCAL GOVERNMENT UNITS have requested a temporary, limited <br />exemption from enforcement of a state procedural law(s) governing delivery ot services; <br />AND WHEREAS, the BOARD has granted the LOCAL GOVERNMENT UNITS a temporary, <br />limited exemption from enforcement of a state procedural law(s) governing dehverj' of services; <br />.SOW THEREFORE, it is agreed. <br />I.EXEMPTION CITATION. The LOCAL GOVERNMENT UNITS ARE hereby granted <br />a temporary, limited exemption from enforcement of M.S. 412.02 which requires that city <br />council members serve terms of four years. The Cities of Long Lake and Orono shall be <br />exempt from enforcement of the cited statute(s) for the duration of this agreement. <br />II.SERVICE DELIVERY. In the event that the merger proposed for referendum scheduled <br />for September 12, 2000 for two cities is successful, city council members elected in <br />November 2000 may serve terms of less than four years. <br />III.OUTCOMES. Through the implementation of this exemption, the LOCAL <br />GOVERNMENT UNITS intend that consistent with the Consolidation Plan approved by <br />the BOARD, that a joint ten member City Council v'ould govern the new municipality- until <br />a new seven member Council was elected combined city. <br />Page 1 of 3 <br />i
