V . <br />- <br />MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />MONDAY, JULY 24, 2000 <br />(1^2600 BRIAN KERBER, Continued) <br />Peterson stated a hardship in her view is inherent to the land and not the need for additional <br />storage space. <br />Mayor Jabbour commented he would like to sec the properties in Orono be as uncluttered as <br />possible. <br />Sansevere moved, Jnbbour seconded, to approve the variance to permit construction of a <br />2,160 square foot pole barn and a variance to the street lot line for the property located at 740 <br />Orchard Park Road, with the stipulation being that if the Applicant wishes to exercise <br />his right as presently exists in the Ordinance to construct an additional shed, that building <br />must comply to City standards, and with the understanding the Applicant will store his <br />vehicle and trailer inside the newly constructed structure, and further with the understanding <br />that the existing two-stall garage will be relocated as far back as possible. <br />Jabbour commented in his view the hardship is based on the land and the Applicant relinquishing <br />his right to construct four structures on his property. <br />VOTE: Ayes 4, Nays 1, Peterson Opposed. <br />Peterson stated in her view there is no hardship inherent with the land and that the Applicant should <br />be required to limit the size of the building to 2,000 square feet. <br />(#7) JAMES ANDERST - NARROWS SALOON, 3380 SHORELINE DRIVE - PERMIT <br />REVIEW <br />James Anderst, Applicant, was present. <br />Weinberger stated the City of Orono has issued a building permit to the Applicant to allow the <br />additional remodeling of the Narrows Saloon which includes c.xpanding the bar into the former <br />Minnetonka Photo space, which is now vacant. This property is located in the B-l Retail Sales <br />Business District in which a Class II Restaurant Is defined as a restaurant which scr\cs <br />into.xicating liquor or has live entertainment. Weinbcrgei stated the e.vpansion of the building <br />requires the owner to obtain a conditional use permit since Class II Restaurants arc allowed by <br />a conditional use permit. <br />The applicant has made a formal application for a conditional use permit, but would technically <br />be considered to be an after-the-fact application since the owner was permitted to proceed <br />forward with the remodeling and e.xpansion of the restrooms. <br />Weinberger stated the proposed expansion meets all setback requirements for the B-l District, <br />with no change to the footprint of the building except for the small expansion to the restroom area. <br />Weinberger stated the expansion to the restroom is needed in order to make the restrooms <br />handicap accessible. <br />Subsequent to issuance of a building permit, Stafi* determined that a conditional use permit is <br />Page 6
