CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants a <br />variance to Municipal Zoning Code Section 10.27, Subdivision 5 (B) to allow a front yard setback <br />of 42' where 100' is required and a side yard setback of 24.2' where 50' is required to permit an <br />addition to the existing residence. Approval is subject to the following conditions; <br />1.Council approval is based on the site plan submitted by the applicant attached to this <br />resolution as Exhibit A. Any amendments to the site plan may require further <br />Planning Commission and City Council review. <br />Applicant is advised that if this project ultimately results in substantial removal of <br />the existing residence due to unforeseen circumstances, the City Council shall have <br />the right to reconsider this approval to determine whether the conditions of this <br />resolution remain applicable. <br />3.Authorities granted by this variance run with the property not with the applicant, <br />but are permissive only and must be exercised by application for a building permit <br />within one year of the date of Council approval, or these variances will expire on that <br />date (July 24, 2001). <br />4.Violation of or non-compliance with any of the terms and conditions of this <br />variance shall constitute a violation of the zoning code, shall automatically terminate <br />any authority granted herein, and shall be punishable as a misdemeanor. <br />5.The undersigned applicant has read, understood and hereby agrees to the terms of <br />this resolution and on behalf of himself, his heirs, his successors and assigns, <br />hereby agrees to tlie recording of this resolution in the Chain of Title of the property. <br />Adopted by the City Council of the City or Orono, Minnesota at a regular meeting held on the 24th <br />day of July, 2000. <br />Page 3 of 6 <br />■i
