mr <br />E!, <br />g; <br />m <br />y <br />a ' . <br />t <br />The concrete sidewalk is located on the southwest side of the residence and is 80 s.f. It is in poor <br />condition and the applicants wish to replace it with grass to help with drainage. The sidewalk is <br />located in both the 0-75' and 75-250' setback areas. <br />Th j removal of the sidewalk will result in a decrease of hardcover in the 0-75' setback area <br />to 1,512 s.f. (55.0%), where 1,592 s.f. (57.9%) exists and 0 s.f. (0%) is allowed. <br />The paver patio and removal of sidewalk will result in a decrease of hardcover in the 75-250' <br />setback area to 643 s.f. (64.95%), where 707 s.f. (71.4%) exists and 247.5 s.f. (25%) is <br />allowed. <br />Statement of Hardship; <br />The applicants have included their statement of hardship in Exhibit B. The applicants should also <br />be asked for their testimony regarding this issue. <br />Issues for Consideration; <br />1 . The structural coverage on the lot is not increasing, and hardcover is decreasing, <br />2. In 1994, the property owner at 3345 Crystal Bay Road was granted a “0 setback” variance to <br />allow a shed to be located at the rear property line and outside the Dakota Rail right-of-way. <br />3. The City does not have authority to grant approval to replace the deck in its current location <br />because part of it encroaches into the Dakota Rail right of way. Applicant has no other location <br />feasible for a patio, and the proposed 170 s.f. patio is not excessive in size. <br />4. The lot is extremely undersized for LR-IC. <br />5. Other issues raised by the Planning Commission. <br />Staff Recommendation; <br />Staff recommends approval of the variances to allow the applicants to remove the concrete <br />sidewalk and to remove and replace the existing deck with a paver patio. <br />Options for Action: <br />1. Recommend approval of variances. <br />2. Recommend denial of variances. <br />3. Table for additional information. <br />4.
