The project involves moving the new residence back out of <br />the 0-75' setback area, meeting the City standard and being more in alignment with adjacent <br />properties. A Conditional Use Permit is required for grading within five feet of the property line. <br />A variance is required for hardcover in the 75-250' setback area. No other variances are required for <br />the proposed new residence. <br />Applicants’ are required to submit engineered plans for any retaining walls that will be over 4' in <br />height before issuance of a building permit. <br />1. Section 10.22, Subd. 2 and Section 10.56, Subd. 16 (L)(2): Hardcover in 75-250' Setback <br />Area: To permit 2,647 s.f. (46.93%) where 1,682 s.f (27.58%) exists and 1,525 s.f (25%) is <br />allowed. <br />PLANNING COMMISSION: <br />The Planning Commission recommended by a 5 to 0 vote to: <br />Approve the application as presented. <br />STAFF RECOMMENDATION: <br />Applicant has worked diligently with staff and the Planning Commission throughout the past year <br />and has made numerous revisions to the plan to minimize the number and magnitude of variances <br />required. The current plan is acceptable to staff and the Planning Conunission, and staff <br />recommends approval.
