The pond was dredged by <br />the property owner to the south for a natural pond within a wetland area. Because the pond required <br />greater than 500 cubic yards of excavation a conditional use permit is required. The wetland area <br />is mostly a Type I wetland, and not a City protected wetland. <br />Planning Commission Recommendation: The Planning Commission reviewed the Conditional Use <br />Permit application on May 15, 2000 and recommended approval by a vote of 5 to 0 based on the <br />following conditions being met by the applicant: <br />1. <br />2. <br />3. <br />4. <br />5. <br />Applicant applies for a land alteration permit. <br />A protective covenant is filed in the chain of title of the affected properties as an advisory <br />to property owners the wetland is subject to WCA regulation. <br />A final as built survey, indicating finished elevations of the pond is submitted to the City and <br />accepted by the City Engineer. <br />Verification a MCWD permit has been approved for the pond construction. <br />Conservation and Flowage Easement granted over the protected area to ensure restoration <br />of natural vegetation. <br />xia JMc )
