F <br />r <br />( <br />has increased substantially and the non-resident boats are now used for overnight and weekend <br />habitation. <br />Based on the current information that we have gathered and the Orono ordinances governing <br />non-conforming property, we would ask that the Planning Commission take the following <br />actions with respect to the Ginther/Ault propcrcy: <br />Return the property to w'hat existed at the time of the 1968 ordinance governing non- <br />conforming property. Specifically that \vould mean: <br />- Eliminate one dock and go back to the one dock and one boat that existed at the property* <br />in 1968. <br />- Return the property to single ovMiership as e,xisted in 1968. <br />- Eliminate the electricity that was not there prior to 1990. <br />Per our last memo for the April meeting, we’d also like to request the following for these <br />properties: <br />No Boat Slip Rental - Ault has rented his slip for a number of years and we understand that <br />this is not legal. <br />Blocking of Fire Hydrant - There is currently a 4-car gravel car park that is immediately <br />adjacent to and blocking access to the only fire hydrant in the immediate area. No permit <br />was ever obtained to put in this driveway and we believe it is not legal to block a fire hydrant. <br />Burglar Alarms - Ginther has had a burglar alarm that in the jiast has malfunctioned, going <br />off at all hours of the day and night, disturbing the peace and sleep in the neighborhood. We <br />would ask that burglar alarms be eliminated. <br />Parking for Only One Car Per Dock - The other non-resident non-conforming lots are <br />allowed one car per slip for parking. We would ask that those agreements tie in to this non- <br />conforniing non-resident property as well. <br />N( ’se and Hour Restrictions - Since prior to 1968 these docks were used for daylight <br />boating and because this is a very private and narrow channel area, we’d request that boats <br />not come and go from these doclb after 10:00 p.m. on weeknights and 11:00 p.m. on <br />weekends. <br />We believe the above requests are consistent with the ordinances identified and summarized by <br />Bruce Malkerson in his legal opinion included in our April submission. <br />We plan to be at the meeting on Monday, May 15 to discuss this issue. We appreciate th*' <br />opportunity to present this new additional information and respectfully ask for the Plam.mg <br />Commission’s help in resoKing the issues identified above.
