4. <br />5. <br />A.Locating the pool on the lakeside of the property screens the structure <br />from view from the road. <br />B.A group of mature trees are located around the area designated for the <br />swimming pool and the area is lower than adjacent properties for <br />minimal impact and screening to surrounding residences. <br />C.The pool is located approximately 150 feet from the nearest adjacent <br />residence. If the pool were relocated to the north side of the property the <br />pool would be visible and within 60 feet of the residence. <br />D.The City On-Site Systems Manage has approved a variance to the Septic <br />Code that would permit an alternate septic site to be within 75 feet of <br />an adjacent water supply well, but not less than the State requirement of <br />50 feet. <br />E.The property owner of 520 North Arm Drive has submitted a letter to the <br />City of Orono stating knowledge of the variance to permit a septic site <br />within 75 feet of the well. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safet>’ and <br />welfare of the community. <br />Page 2 of 4 <br />i
