5. "Construction" Any action which in any way affects the physical components <br />of any new or existing ISTS, including constructioa installation, extension, alteration or repair, not <br />to include pumping. <br />6. "Contractor" - A person licensed under the provisions Minnesota Rules Chapter <br />7080 to engage in the business of site evaluation, system design, system construction and pumping. <br />7. "Disposal" - The evaporation or absorption of purified liquids after treatment of <br />the raw sewage. <br />8. "Existing System" - Any ISTS constructed and in use prior to the adoption of this <br />Section. “New systems ” shall become "existing systems ” at the time of final inspection and approval <br />by the City. <br />9. "Failing System" - Any ISTS that discharges sewage to a seepage pit, cesspool, <br />drywell or leaching pit. In addition, any ISTS posing an imminent threat to public health or safety <br />as defined in Minnesota Rules Chapter 7080 shall be considered failing. <br />10. "Inspection Report" - The official report of the results of the inspection by the <br />City, including any official orders to repair or replace a non- compliant or failing ISTS. <br />11. "ISTS" - An Individual Sewage Treatment System as defined in Minnesota <br />Rules Chapter 7080. <br />12. "Minnesota Rules Chapter 7080" - The Minnesota Pollution Control Agency <br />standards for the design, construction, installation and maintenance of Individual Sewage Treatment <br />Systems extracted from the current Minnesota Rules as adopted in this Section. <br />13. "New System" - Any proposed ISTS or any newly constructed ISTS which <br />construction takes place after the adoption of this Section, shall be a "new system" until the time of <br />final inspection and approval by the City. <br />14. Non-Compliant System" - A prohibited ISTS; an ISTS located within a <br />designated 100-year flood plain; any ISTS which may or may not meet all the location, design, or <br />construction standards of the current Orono Municipal Code and which is failing for any reason; and <br />any ISTS with less than three feet of unsaturated soil or sand between the distribution device and <br />the limiting soil characteristics. <br />15. "Owner" - Any person having legal or equitable title or sufficient proprietary <br />interest in any building or land subject to the provisions of this Section. For purposes of notification, <br />the owner shall be the occupant of the property or the person listed as taxpayer on the current tax <br />rolls. <br />16. " Pollutants" - Bacterial or chemical impurities including pathogenic bacteria, <br />infectious viruses, toxic chemicals, excess nutrients (nitrogen and phosphorous), unpotable water, <br />or septage. <br />Page 2 of 16 <br />.
