V <br />I I <br />LMCD Permit <br />Greg Nybeck, Executive Director of the LMCD, has stated the Hennepin County Sheriffs Water <br />Patrol has reviewed the matter of the proposed dock extension and concluded the actual dock <br />structure does not create a navigational problem in the channel. The primary concern with the dock <br />extension at the previous Planning Commission meeting is distance across the channel. In the permit <br />approved originally by the LMCD the distance measured from shoreline to shoreline was listed at <br />approximately 120'. Staff has concluded the actual distance between the proposed dock extension <br />to the opposite shoreline is approximately 75’. There is no change to the status of the LMCD permit. <br />Mr. Nybeck did agree parking of boats on the north side of the dock could obstruct access to other <br />docks in the channel. In his letter, dated October 13,1999, he states it is the responsibility to ensure <br />that boat storage on the north side of the dock does not cause a navigational problem to other docks <br />in the area. <br />In discussions with Mr. Randgaard, both sides have agreed that the entire north side of the dock <br />cannot be used for parking of additional boats. Staff has communicated its concern about any <br />parking on the north side of the dock. Mr. Randgaard has stated he would be willing to have a <br />condition of approval that no parking would be allowed on the 14' dock extension and no more than <br />one boat would be permitted to dock on the north side of the structure. The LMCD has stated they <br />do not have a provision to prohibit parking of boats in this location. <br />PLANNING COMMISSION RECOMMENDATION <br />On a vote of 5 to 0 the Planning Commission recommended approval of the variances and <br />conditional use permit subject to the following conditions: <br />1. The applicant maintains active licenses with the LMCD and DNR. <br />2. <br />3. <br />4. <br />The dock does not cause navigational problems or obstruct access within the channel <br />per LMCD requirements. <br />Future replacement or alteration of the dock will require a new conditional use permit <br />from the City of Orono. <br />No parking of boats is permitted along the 14' extensions to not further impact <br />channel access. <br />5. The temporary- dock shall have a dock permit issued from the City of Orono. <br />STAFF RECOMMENDATION <br />Staff is recommending approval of the conditional use permit to permit a permanent dock <br />extension of 14'.
