223517v6 <br /> <br />Ordinance No. 788 <br />CITY OF MONTICELLO <br />WRIGHT COUNTY, MINNESOTA <br /> <br />AN ORDINANCE AMENDING MONTICELLO CITY CODE TITLE 11 - BUSINESS <br />REGULATIONS, CHAPTER 112 – BUSINESS LICENSES AND REGULATIONS, BY <br />ADDING SECTION 112.60 REGARDING CANNABINOID PRODUCTS <br /> <br /> <br />THE CITY COUNCIL OF THE CITY OF MONTICELLO, MINNESOTA, HEREBY <br />ORDAINS: <br /> <br />SECTION 1. Monticello City Code Title 11, Chapter 112, is hereby amended by adding Section <br />112.60, Cannabinoid Products, as follows: <br /> <br />§ 112.60 CANNABINOID PRODUCTS. <br /> <br />(A) Purpose. This subchapter is designed to permit the reasonable sale of <br />cannabinoid products while protecting the general welfare of the city’s youth, <br />residents, and visitors by limiting the sale of cannabinoid products to those <br />establishments licensed by Wright County to sell tobacco. <br /> <br />(B) General requirement. No person, firm, partnership, or corporation shall sell <br />cannabinoid products unless: <br />1. the seller also holds a retail tobacco license from Wright County, <br />Minnesota and meets the definition of “tobacco products shop” as <br />defined by the Wright County Code of Ordinances. <br /> <br />2. the seller is abiding by all requirements under Minn. Stat. § 151.72 and <br />related laws. <br /> <br />(C) Definitions. <br />1. Cannabinoid product shall mean a chemical compound derived from the <br />cannabis plant or synthetically derived from the cannabis plant. <br />2. Cannabinoid product means any edible or nonedible cannabinoid <br />product authorized for sale in Minn. Stat. §151.72 and intended for <br />human consumption whether chewed, smoked, absorbed, dissolved, <br />inhaled, snorted, sniffed, or ingested by any other means. <br />(D) Exemptions. <br />1. Except as regulated above, there is no requirement to obtain a tobacco <br />license from Wright County to sell cannabinoid products wherein the <br />only cannabinoids present are non-intoxicating cannabinoids, such <br />Cannabidiol (“CBD”) or Cannabinol (“CBN”). <br />
