<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7344 <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING VARIANCES FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-1433 <br /> <br />FILE NO. LA22-000065 <br /> <br /> WHEREAS, on December 6, 2022, Tim and Leslie Oare (hereinafter the “Applicants”), <br />applied for variances from the City Code for the property addressed 2967 Casco Point Road and <br />legally described as: <br /> <br />Tract B, Registered Land Survey No. 14 70; and <br /> <br />That part of Tract A, Registered Land Survey No. 1470, Hennepin County, Minnesota <br />which lies southerly of the following described line and its extensions: Commencing at the <br />most Easterly corner of said Tract A; thence on an assumed bearing of North 9 degrees 03 <br />minutes West along the easterly line of said Tract A a distance of 53.76 feet to the point of <br />beginning of said line; thence South 63 degrees 06 minutes 06 seconds West a distance of <br />85.63 feet to an intersection with a segment of the northwesterly line of said Tract A and <br />said line there ending, Hennepin County, Minnesota. (hereinafter the “Property”); <br /> <br /> WHEREAS, the Applicant has made application to the City of Orono for a variance to <br />Orono Municipal Zoning Code Section 78-1433 to allow an Accessory Dwelling Unit (hereinafter <br />the “ADU”) use on a property 0.73 acre in area where 1.0 acre is required and independent (not <br />shared) utility connections; and <br /> <br /> WHEREAS, on January 17, 2023, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br /> <br /> WHEREAS, on January 17, 2023, the Planning Commission recommended denial of the <br />variance; and <br /> <br /> WHEREAS, on February 13, 2023, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff and finding practical difficulties, <br />directed preparation of findings for approval of the variances. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that on February 27, 2023, the City Council of <br />Orono, Minnesota hereby approves the requested variances as described above based on one <br />or more of the following findings of fact concerning the Property:
