RELEVANT LINKS: <br />League of Minnesota Cities Information Memo: 6/23/2022 <br />LMCIT Liability Coverage Guide Page 36 <br /> • The sewer backup resulted from a condition in the city’s sewer system. <br />• The sewer backup was not the result of an obstruction or other condition <br />in sewer pipes or lines which are not part of the city’s sewer system or <br />which are not owned or maintained by the city. <br />• The water main break damage to property of others was not caused by city <br />negligence. <br />• The sewer backup or water main break was not caused by or related to an <br />excluded incident. <br />• The date of the occurrence giving rise to the claim for sewer backup or <br />water main damages must be on or after the retroactive date shown on the <br />city’s endorsement. <br /> <br />LMC information memo, <br />National Flood Insurance <br />Program. <br />The no-fault coverage will not pay for any damages or expenses which are or <br />would be covered under a National Flood Insurance Program (NFIP) flood <br />insurance policy, whether such insurance is in effect; or for any costs which <br />the property owner has been reimbursed or is eligible to be reimbursed by any <br />homeowners’ or other property insurance. <br /> Following are other incidents that are specifically excluded under the no-fault <br />coverage: <br /> <br />42 U.S.C. §§ 5121-5206. <br />• Any weather-related or other event which has been declared by the <br />President of the United States to be a major disaster pursuant to the <br />Stafford Act. <br />• Any interruption in the electric power supply to the city’s sewer system or <br />to any city sewer lift station which continues for more than 72 hours. <br />• Rainfall or precipitation which exceeds 2.0 inches in a 1-hour period; or <br />2.5 inches in a 3-hour period; or 3.0 inches in a 6-hour period; or 3.5 <br />inches in a 12-hour period; or 4.0 inches in a 24-hour period; or 4.5 inches <br />in a 72-hour period; or 5.5 inches in a 168-hour period. <br /> b. Coverage limits <br /> The basic limit for sewer backups is $10,000 per building per year, regardless <br />of the number of occurrences or the number of claimants. The city also has <br />options to purchase higher limits of $25,000 or $40,000 per building. A <br />structure or group of structures that is served by a single connection to the <br />city’s sewer system is considered a single building. <br /> <br />See Section II.R, Sewer <br />backups. <br />Only true no-fault claims are counted toward the limit. Claims for damages <br />caused by city negligence, for which the city would be legally liable in any <br />case and for which would be covered under LMCIT’s standard liability <br />coverage, are not charged against that limit.
