This application is regarding variances to expand the existing home in a nonconforming <br />location. <br /> <br />2. MN§15.99 Application Deadline. The application was received on October 19, and considered to be <br />complete on October 27th. The 60-Day review period has been extended and expires on February 24, <br />2023. <br /> <br />3. Background/ Summary. The existing home on the property is situated 20 feet from the OHWL, <br />almost entirely within the 75-foot <br />setback; most of home is also within <br />the average lakeshore setback. The <br />deck is cantilevered 7-feet over the <br />lake. <br /> <br />4. Variance Description. The <br />applicant has requested 75-foot lake <br />setback, average lakeshore setback, <br />and hardcover variances in order to <br />conduct a major home renovation <br />including additions to the footprint <br />and creation of a second floor. <br /> <br />Responding to Staff and Planning <br />Commission feedback, the applicant <br />revised their plan to remove footprint <br />expansions and reduce hardcover <br />proposed within the 75-foot setback <br />(Exhibit A). The footprint expansions <br />are shown in yellow on the inset <br />image. A revised hardcover level of <br />7,380 square feet (32.6%) is <br />proposed; reflecting a reduction of 51 <br />square feet from the previous proposal and 275 square feet from the existing condition (existing 33.9%). <br />Additionally, the proposed 2nd story has been pulled back from the lake approximately 12 feet, reducing <br />the encroaching mass. <br /> <br />5. Planning Commission Vote and Comment. On November 21st, the Planning Commission held a <br />public hearing. Following the public hearing the Planning Commission voted 3 to 1 on a motion to deny <br />the requested variances as applied. Commissioner Kraemer dissented, indicating his support for the <br />project. The draft minutes are attached as Exhibit E. <br /> <br />6. Public Comment.
