This application is regarding the Average Lakeshore Setback in order to construct a new <br />single-family home. <br />2.MN§15.99 Application Deadline. The application was received on October 17, 2022 and considered <br />to be complete on October 20, 2022. Therefore the 60-Day review period expires on December 19, 2022. <br />3.Background/ Summary. The applicant is requesting a variance from the Average Lakeshore <br />Setback in order to construct a new single-family home in a similar footprint as the existing home on the <br />lot. The lot is located on a peninsula and therefore has an extreme Average Lakeshore Setback that <br />eliminates a conforming building envelope. All other setbacks and zoning requirements are met. <br />4.Planning Commission Vote and Comment. On November 21, 2022, the Planning Commission held <br />a public hearing, no comments were made. The Commission reviewed the application and noted that the <br />new house location eliminated the encroachments within the 75’ setback and therefore reducing the <br />nonconformities to the site. Following the public hearing the Planning Commission voted 4 to 0 on a <br />motion to approve the requested variance as applied. <br />5.Public Comment. Adjacent Property Owner Acknowledgment Forms were received (PC Exhibit H), <br />no other public comments were received. <br />6.Staff Recommendation.
