r <br />•« <br />. ,j <br /><i . ! <br />Writers Direct Phone: 612-403-7832 <br />February 17, 2000 <br />Mr. Ron Moorse <br />City of Orono <br />City Administrator <br />PO Box 66 (2750 Kelly Parkway) <br />Orono, MN 55323-0066 <br />re: Completion of Metricom's ROW Agreement <br />Dear Ron: <br />Thanks for your catt and, interestoo-tho phone-Friday, concerning final steps to bring Metricom's <br />innovative new "Ricochet®" wireless internet and data service to residents and businesses in <br />Orono. <br />I havo attached one "final revision" and thren"executable originals" of Metricom's "Right-of- <br />Way Permit and Facility Use Agreement" (ROW) for signature by you and Orono's Mayor. <br />As we discussed,^ the." final revision" of the.ROW was done in concurrence with Mr. Tom <br />Grundhoefer, General Counsel for the League of Minnesota Cities (LMC), and with Mr. Jim <br />Strommen, attorney for the Suburban.Rate Authority (SRA). All changes were finalized in late <br />December, 1999. <br />If ynii hflvp h«»<»n aMa tn read, the memo s which. Jim Strommen has written about his work on this <br />"model" ROW, you most likely know that we were conscientious in our work with both the <br />LMC and SRA, andrevisedthe document to their satisfaction. We believe this ROW goes <br />beyond statutory requirements for conq)ensating cities for Metricom's very minimal impact on <br />public rights-of-way. <br />Our radios require na digging in or adjacent to streets, no underground conduits, no street cuts, <br />no significant inconvenience to traffic (since we estimate only 15 minutes to install each pole-top <br />deviceX and only about 5 to 7 "shoe-box" size pole-top devices per square mile mounted on <br />existing pole structures. This is truly minimal impact on your right-of-way, but it brings a <br />significant benefit of new competitive services to your citizens! <br />We also think this ROW is the "model" of a fair way to document methods for uring public <br />rightsrof-way to bring innovative new services to the public, which in turn can attract people and <br />. . % .e* n
