• <br />ORONO CITY COUNCIL MEETING <br />MINUTES FOR FEBRUARY 14, 2000 <br />(#2550 Charles Van Eeckbout, continued) <br />Mayor Jabbour commented that the city would not allow sewer availability to increase lot <br />density. All Council members agreed. The applicant must demonstrate a hardship to allow more <br />than the permitted density on the site. <br />�Ir. McCusky, the adjoining property owner, was present with legal representation arguing that <br />the applicant had not made arrangements for proper legal access to the subdivision. He was <br />concerned that approving the subdivision may imply some legal rights to access. <br />Barrett confirmed the ease1nent to the property was for driveway purposes and may not be <br />adequate to serve as access to the subdivision. Barrett stated the application deadline is March <br />2, 2000. The applicant must present a letter to the City of Orono to extend the deadline. <br />Mayor Jabbour stated the applicant should provide a letter requesting the application be tabled, <br />giving the applicant time to resolve the issues of dry buildable acreage and access to the property <br />through a designated outlot. <br />Kelley moved and Peterson seconded to table the application until the applicant requests <br />further review. <br />Vote: Ayes S, Nays 0. <br />SA. #2540 Bradley Hoyt, 2523 Kelly Avenue -After-the-fact Conditional Use Permit <br />Mr. Sheridan provided a letter requesting the application be tabled until the end of March. The <br />letter also stated that the property owner, Mr. Hoyt, has granted the city an extension of the time <br />limits for approval. <br />Kelley moved, and Petenon seconded, to table the application until the end of March. <br />Vote: Ayes S, Nays 0. <br />*6. #2552 STEVEN AND SHEILA SIGEL, 1399 PARK DRIVE -VARIANCES <br />RESOLUTION NO. 4421 <br />Flint moved, Petenon seconded, to approve and adopt Resolution No. 4421, a Resolution <br />Granting Variances to Municipal Zoning Code Section 10.22, Subdivision 1 (B) and Section <br />10.56, Subdivisions 16 (C)(6). <br />VOTE: Ayes S, Nays 0. <br />5
