Bri';gs, President of Wayzata Marine, is acquiring Lakeside <br />Ma.ina. Wayzata Marine currently operat.s a retail store/service facility on Highway 12 in Wayzata <br />which will be closing, and those functions will be moved to the Lakeside location. Mr. Briggs is <br />requesting approval of a 2000 Commercial Marina License to operate his business at this site. <br />Wayzata Marine will continue many facets of Lakeside’s past operation including rental of in-water <br />boat slips; sales of boats, motors, trailers and marine accessories; repair and servicing of boats; on <br />land boat storage both summer and winter; and marine fuel sales. The head pumpout facility will <br />continue in operation as an allowed accessory use. None of the uses defined by code as Conditional <br />Uses are proposed. <br />The closing for Briggs’ purchase of this property is scheduled for March 15,2000, hence staff <br />agreed to place this item on the Council's February 28 agenda to allow applicant ample time to <br />resolve any issues that may arise. While this license is for a new owner, the business operation at <br />the site will continue essentially as a full-service marina as it has for many years. <br />List of Exhibits <br />A - Wayzata Marine 2000 License Application & Letter of Request <br />B - Submitted Summer Parking Plan <br />C - Submitted Winter Storage Plan <br />D - Certificate of Insurance <br />E - 1999 LMCD License and Dock Layout <br />License Review <br />This site is located in the B-2 Lakeshore Business District in which marine operation is the intended <br />permitted use. A marina has operated at this site for more than three decades. The proposed use is <br />not changing at this time, none of the proposed uses requires a CUP, and no physical changes to the <br />site are proposed at this time, hence no specific zoning application is required in order to issue the <br />applicant a license. <br />Municipal Code Section 5.43, Subd. 4 allows Council to hold a public hearing on a marina license <br />if Council deems it appropriate, but a hearing is not mandatory unless the applicant requests one in <br />the case of a revocation or denial. Staff feels there is no need for a public hearing on this application.
