2.
3.
5.
6.
The property is located in the RR-IB, Lakeshore Residential Zoning District
requiring 2 acres in area. The property consists of total area of 14,000 s.f. or
.32 acres.
The Planning Commission reviewed this application on February 23, 2000 and
recommended approval on a vote of 4 to 0.
4.The Planning Commission made the following findings of fact:
A.The residence was built prior to current zoning standards.
B.
C.
D.
E.
The lot is unusually small and narrow for the RR-IB zoning district.
The property is not currently served wUh a garage.
The proposed garage location will allow the presentation of an existing
mature maple tree in the rear yard.
No hardship exists to justify lot coverage in excess of the 15% allowed
by code. Allowed lot coverage is 2,100 s.f.; the existing house is 1512
s.f. leaving an allowance of 588 s.f. for accessory buildings.
The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicants and the effect of the proposed variance on the health, safety
and welfare of the community.
