The proposal will also require variances and a conditional use permit for land alteration, <br />filling in a wetland and road width standards. The DNR is reviewing the proposal for permits to <br />allow filling and crossing a protected tributary (Long Lake Creek) and crossing the Luce Line Trail <br />for sewer extension to the south (Fox Ridge). <br />Planning Commission recommended by a vote of 7 to 0 to deny the request for subdivision, <br />conditional use permit and variances based on a request by the applicant to move this item <br />forward to the City Council. <br />The Planning Commission was prepared to table this application to allow additional time for the <br />applicant to revise the Planned Residential Development (PRD) and implement changes to the <br />proposed lot layout based on reconunendations by the Commission. Mr. Van Eeckhout then <br />requested the Planning Commission take action on this item to allow the City Council to review the <br />proposed lot layout and conditional use permit for a PRD. Concerns by the Planning Commission <br />included the size of the four lots located in the northeast portion of the proposed plat and no <br />dedication of conservation space. A PRD would normally require preservation of natural open <br />spaces. This concept does not have any conservation outlots proposed. It would not be desirable <br />to accept areas designated as wetlands as conservation areas since they would be considered <br />protected areas by the granting of conservation and flowage easements with a standard plat. Please <br />review the draft Planning Commission minutes attached as Exhibit M. <br />4
