CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants <br />variances to Municipal Zoning Code Section 10.22, Subdivision 1(B) and Section 10.56, Subdivision <br />16 (C)(6) to allow the construction of an addition to the garage and an addition to the second story <br />of the existing home that encroacht s 20' into the average lakeshore setback and per Section 10.22, <br />Subdivision 2 and Section 10.56, Subdivision 16 (L)(2) to allow 5,745 s.f. (28.27%) hardcover in <br />the 75-250' lakeshore setback area where 6,241 s.f. (30.7%) exists and 5,081 s.f. (25%) is allowed <br />and per Section 10.23, Subdivision 6(B) to allow a side yard setback of 10.62' to the north property <br />line and 9.93' setback to the south property line where 30' setback is required. Approval was subject <br />to the following conditions: <br />1. <br />2. <br />3. <br />4. <br />Council approval is based on the site plan submitted by the applicants attached to this <br />resolution on Page 6. Any amendments to the site plan may require further Planning <br />Commission and City Council review. <br />Authorities granted by this variance run with the property not with the applicants, but <br />are permissive only and must be exercised by application for a building permit within <br />one year of the date of Council approval, or this variance will expire on that date <br />(January 24, 2001). <br />Violation of or non-compliance with any of the terms and conditions of this variance <br />shall constitute a violation of the zoning code, shall automatically terminate any <br />authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the terms of <br />this resolution and on behalf of themselves, their heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the Chain of Title of the property. <br />Page 3 of 6
