ORONO CITY COUNCIL MEETING <br />MINUTES FOR DECEMBER 13,1999 <br />CITY ADMINISTRATOR ’S REPORT <br />(#13) PUBLIC WORKS SITE EXPANSION - EMINENT DOMAIN OPTION <br />Jabbour said he heard this parcel of land will be proposed for development in the near future. <br />Jabbour asked Barrett to comment on the condemnation procedure. <br />Barrett said there are essentially two methods of proceeding to condenm property in <br />Minnesota. One is a quick take by which you announce that you will get title within 90 days <br />and that you have put some percentage of the value in the bank against an appraisal. After 90 <br />days the City gets the title and it is irreversible. There can also be a more general <br />condemnation which commences the condemnation action. The court appoints commissioners, <br />the commissioners set a value, the value goes to the court and the City can withdraw from <br />that procedure at some point. But the Council members should be aware that the downside of <br />that is that if the procedure is discontinued, the City would have to pay the other party’s costs <br />and attorney ’s fees. <br />Flint said perhaps the Council could authorize Moorse to start the proceedings without <br />actually filing for a general condemnation. <br />Kelley asked why ti:e City would not want to do a quick take. <br />Barrett said the City would have no control over the price of the land. <br />Jabbour said the Council should authorize staff to start the condemnation proceedings and to <br />send a letter to the property owner to tell them the City is about to proceed with this <br />condemnation. The Council also instructed staff to contact the School District regarding the <br />purchase of land north of the City’s property. <br />Barrett suggested that the Council direct staff to prepare a resolution authorizing the taking of <br />this land. <br />Kelley moved, Peterson seconded, to direct staff to prepare a resolution authorizing the <br />acquisition of Outlot B, Willow Properties Addition through the eminent domain <br />process. VOTE: Ayes 5, Nays 0. <br />(*#14) PARK COMMISSION REAPPOINTMENTS <br />Peterson moved, Kelley seconded, to authorize staff to place a news release in the local <br />newspapers requesting candidates to serve on the Park Commission.
