ORONO CITY COUNCIL MEETING <br />MINUTES FOR DECEMBER 13,1999 <br />(M) §2522 BANCOR GROUP, INC - Continued <br />Kelley asked what if someone wants to put in a tennis court or a swimming pool? <br />Jabbour said no above-grade accessory structures. <br />Sansevere said what if someone wants to put in a gazebo attached to the pool area. He asked <br />if they were trying to eliminate sheds. He asked if their covenants allow for a pool? <br />Newman said yes, but he thinks the covenants would prohibit a gazebo. <br />Jabbour said that above-grade accessory structures should be prohibited. <br />Newman said the covenants could be submitted for review by st^ and that becomes one of <br />the conditions the PRD. <br />Jabbour asked again about the height of the buildings. He asked about the present permitted <br />height. <br />Weinberger said it is the average peak and its 30 feet, so essentially you could have a structure <br />taller than 30 feet in height if the entire second floor would not be used as livable space. <br />Kelley said he is not in favor of changing that. <br />Peterson and Sansevere agreed. <br />Jabbour said he feels public water should be provided. <br />Newman said that then the Council should change its policy on helping the developer pay for <br />bringing water to the site. <br />Kelley said he has a problem with paying for 1,300 feet of pipe to bring water to their <br />property. <br />Kellogg said there is water available closer than 1,300 feet and this needs further study. <br />Kelley said the City has to be consistent in its policies. <br />Newman said they were advised by City staff that in bringing sewer to the site, they would be <br />responsible for the cost of bringing it to the site. They anticipate paying for approximately <br />1,200 feet of line outside of their development. If the City changes it’s policy on paying for <br />water, they should change it for sewer also. <br />Jabbour said that if the City diverts from the current sewer policy, it would bankrupt the City. <br />Page 25
