Substantial property right <br /> is provided by the newly constructed, existing principal structure. The Code provides for <br /> the minimal driveway hardcover necessary to access the Property which was installed <br /> with the home construction. Expansion of an existing improvement or structure is not a <br /> right. <br /> B11."The granting of the proposed variance will not in any way impair health, safety, comfort or <br /> morals, or in any other respect be contrary to the intent of this chapter." Granting the <br /> requested variances would be contrary to the intent of the zoning chapter. <br /> B12."The granting of such variance will not merely serve as a convenience to the applicant, but <br /> is necessary to alleviate demonstrable difficulty."The variances to increase driveway <br /> square footage, improve aesthetics, and increase outdoor living space near the OHWL <br /> are conveniences and are not supported by a demonstrable difficulty. This criterion is not <br /> met. <br /> CONCLUSIONS, ORDER AND CONDITIONS: <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> denies the requested after-the-fact variances as described above.
