T0: Planning Commission Members <br />PROM: Dexter !larston, Zoning Administrate- <br />DATE: May 9, 1973 <br />SUBJECT: Variance - Walter Benhardus •- 4760 ;3ayside Road <br />14r. Benhardus is asking for a variance from two sections of the <br />ordinance. When Mr. Benhardus was applying for a variance from <br />Section 30.040, which requires that a stable be 1S0' from a property <br />line, he war informed that he was in violation of Section 34.037, <br />which requires two acres for the first horse and one acre for each <br />additional horse. Nr. Benhardus has two horses and two ponies on <br />3.62 acres, although an inspection seemed to indicate that the <br />grounds are clean and the animals well care(' for. I will contact <br />the newly created horse owners association fcr their comments <br />regarding this matter. <br />The applicant would also like a 7S' variance from his rear property <br />line setback requirement for a stable. The proposed stable site <br />was chosen because the topography and natural vegetation would at <br />least partially shield the stable from those pa!,sing by and the <br />surrounding neighbors. The accompanying map indicates that the <br />encroachment would be on Village park property .:o the north of the <br />Benhardus' property. Although a variance for'a stable setback <br />requirement from an adjoining residential site might not be des,—cable, <br />this problem would not exist with park property. <br />
