McAuliffe <br />5001 Olson Memorial Highway <br />Minneapolis, MN 55422 <br />Re: Big Island Properties - Record Lots 24 and 27 <br />Dear Mr. McAuliffe: <br />We are in receipt of your correspondence regarding an alternate layout <br />for the above referenced Record Lots. The "RS" zoning district currently <br />designates Lots 1-5, Morse Island Park, as Record Lot 127, and designates <br />Lot 1 of Scrivers Subdivision of Lot E and Lot 6 and part of Lot 7 of Morse <br />Island Park Second Addition as Record Lot 124. It is my understanding that <br />you would propose to split Lot 6 of Morse Island Park 2nd Addition and <br />combine the southern half with Lots 1 and 2 Morse Island and Lot 1 of <br />Scrivers Subdivision of Lot E, Morse Island Park. <br />The proposed division and recombination would leave about 150' of <br />shoreline for Record Lot 27 and about 200' of shoreline, albeit split by a <br />33' public access right-of-way, for Record Lot i24. This would not <br />appreciably change the total area of each Record Lot, while still keeping <br />the existing cabins well within the boundaries of each Record Lot. In my <br />opinion, the only drawback is that under your proposal, both lots will now <br />be divided by right-of-way, and in fact Record Lot 124 would consist of <br />three parcels separated by platted roads. The county will not legally <br />combine property across platted roadways, so that for tax purposes you <br />:Mould still end up with multiple tax statements. Note that the City cannot <br />vacate platted lake access rights-of-way (i.e. "Massasolt Ave".), but there <br />may be a potential to vacate portions of " Moslin Ave" between the two <br />adjacent sets of parcels. <br />In order to revise the current designations of Record Lot 24 and 27 as <br />you propose, you would first have to apply for a "lot line rearrangement" <br />subdivision to split Lot 6. At the same time, you might consider applying <br />for a vacation of the portion of Moslin Avenue that separates the various <br />parcels of your property, although this is not mandatory. Presuming that <br />the City Council would agree with your proposel and would grant subdivision <br />approval with recombination as you propose, a "Special Lot Combination" and <br />Lot Area Variance resolution would be filed in the chain of title of each <br />property.
