TO: Planning Commission Members <br />FROM: Dexter Marston, Zoning Administrator <br />DATE: December 6, 1973 <br />SUBJECT: Variance - Thomas Betz 3775 Bayside Road <br />Thepetitioner has applied for a variance to construct a garage. This <br />is the "famous" home on Stubbs Bay which due to a surveyor's error, <br />was constructed on the County right-of-way. Because the new garage <br />would be a few feet onto the County right -of way, permission should <br />be obtained from them. If written permission is not obtained, I would <br />recommend that a variance be granted to build right up to the lot <br />line. Since the road is not located on the actual right-of-way, and <br />a surveyor's error was made in the location of the home. a variance <br />seeas justified. <br />
