CITY OF ORONO RESOLUTION OF THE CITY COUNCIL No. 7315 slope repair upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. CONCLUSIONS, ORDER AND CONDITIONS: Based upon one or more of the above findings, the Orono City Council hereby grants approval to proceed with an emergency slope repair pursuant to Orono Municipal Zoning Code Section 78-1726 to allow the repair of the existing retaining walls including installation of new retaining walls according to the approved plan, subject to the following conditions: 1. Council approval is based on the entire record, above Findings. 2. The approved emergency slope repair shall conform to the submitted plans (hereinafter the "Plans") submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibit A. 3. Any amendments to the emergency slope repair which are not in conformity with City codes may require further Planning Commission and City Council review. 4. The Applicant shall apply for and receive an after -the -fact variance from City Code 78- 1279 prior to release of the Stop Work order for building permit RAS22-000082 to be resumed for finalization of construction of the walls. 5. Authorities granted by this resolution run with the Property not with the Applicant, but are permissive only and must be exercised by obtaining a variance and building permit for the Plans. After -the -fact variance approval for the expanded retaining walls must be obtained within 90 days of the date of Council approval, or the action will expire after February 26, 2023. 6. Violation of or non-compliance with any of the terms and conditions of this resolution may result in the termination of any authority granted herein.
