CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />No. 7315 <br />slope repair upon the health, safety and welfare of the community, existing and anticipated <br />traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on <br />values of property in the surrounding area. <br />CONCLUSIONS, ORDER AND CONDITIONS: <br />Based upon one or more of the above findings, the Orono City Council hereby grants <br />approval to proceed with an emergency slope repair pursuant to Orono Municipal Zoning Code <br />Section 78-1726 to allow the repair of the existing retaining walls including installation of new <br />retaining walls according to the approved plan, subject to the following conditions: <br />1. Council approval is based on the entire record, above Findings. <br />2. The approved emergency slope repair shall conform to the submitted plans (hereinafter <br />the "Plans") submitted by the Applicant and annotated by City staff, attached to this <br />Resolution as Exhibit A. <br />3. Any amendments to the emergency slope repair which are not in conformity with City <br />codes may require further Planning Commission and City Council review. <br />4. The Applicant shall apply for and receive an after -the -fact variance from City Code 78- <br />1279 prior to release of the Stop Work order for building permit RAS22-000082 to be <br />resumed for finalization of construction of the walls. <br />5. Authorities granted by this resolution run with the Property not with the Applicant, but are <br />permissive only and must be exercised by obtaining a variance and building permit for the <br />Plans. After -the -fact variance approval for the expanded retaining walls must be obtained <br />within 90 days of the date of Council approval, or the action will expire after February 26, <br />2023. <br />6.
